WHAT IS THE ELIGIBILITY CRITERIA

To be invited to apply for this visa, you must earn at least 60 points on the test factors. The following factors are used to determine how many points are awarded:

Age: Based on your age on the day you were invited to apply, you can earn points. When you are invited to apply for this visa, you have to be under the age of 50.

English language ability: At the time you are invited to apply and when you submit your application, you must be able to demonstrate that you have at least passable English language competence. Competent English does not earn you any points.

The results of one of the following English language tests, undertaken not more than 36 months prior to the time you were invited to apply for this visa, can be used to evidence your English language ability.

• International English Language Testing System (IELTS)
• Occupational English Test (OET)
• Test of English as a Foreign Language internet-Based Test (TOEFL iBT)
• Pearson Test of English (PTE) Academic

Nominated occupation: The applicant should propose an occupation from the Consolidated Skilled Occupation List (CSOL) that is relevant to his or her talents, qualifications, and recent work experience, as well as being available in any of the states that would sponsor the state nomination.

Skill Assessment: Before submitting an application, a candidate must receive a positive skill evaluation for the specified occupation.

Maintenance funds: The applicants should show sufficient maintenance funds to obtain sponsorship from state territory.

Health & character requirements: The applicant has to meet health and character requirements.

1.Be invited to apply

• Only if the Govt invites you may you apply for this visa.
• To let know you want to apply for the visa, submit an expression of interest (EOI) on SkillSelect.
• Indicate whether you want a family to sponsor you or if you want a state or territory government agency to propose you for this visa.

2.BE NOMINATED OR SPONSORED

Either an Australian state or territory government agency must nominate you, or you must declare that you will be sponsored by an eligible relative. For more information, see the section below.

To acquire an estimate of your points score, submit an expression of interest (EOI) for the visa.

State and territorial government entities can see your EOI and may nominate you for the visa if you score enough points.If you indicate in your EOI that you will be sponsored by an eligible relative the Department may invite you to apply for a visa in an invitation round.

3.Nomination By an Australia state or Territory Govt Agency

You will receive an invite to apply for the visa if you are nominated. Each state and territorial government agency has its own set of criteria for selecting nominees.

4.Sponsorship by Eligible Relative

Your sponsor must be

• 18 years old or older
• Usually resident in a designated area of Australia
• Be an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen
• Be your eligible relative or your partner’s eligible relative if your partner is also applying for this visa

An eligible relative can be:

• A parent
• A child or step-child
• Abrother, sister, adoptive brother, adoptive sister, step-brother or step-sister
• An aunt, uncle, adoptive aunt, adoptive uncle, step-aunt or step-uncle
• A nephew, niece, adoptive nephew, adoptive niece, step-nephew or step-niece
• A grandparent, or
• Afirst cousin

We must approve your sponsorship before you can be granted a visa.

5.Have the Suitable Skill Assessment

• For your application to be valid, you must declare that you have a suitable skills assessment at time of invitation.
• You will need to provide a copy of this skills assessment with your application.

• If eligible, you will be able to apply for permanent residence through the Permanent Residence (Skilled Regional) visa (subclass 191) – which starts on 16 November 2022.
• Unless you have held your subclass 491 visa for 3 years, holders of the subclass 491 visa can’t
  • Make a valid application for a subclass 820 (Partner) visa
  • Be granted any of the following visas:
    • Subclass 132 (Business Talent)
    • Subclass 186 (Employer Nomination Scheme)
    • Subclass 188 (Business Innovation and Investment (Provisional))
    • Subclass 189 (Skilled (Independent))
    • Subclass 190 (Skilled (Nominated))
    • Subclass 858 (Distinguished talent)
